Terms of Service

EarnWhile is in development and has not been released. No earning provider is enabled, and no opportunities are available. Cash out is unavailable, and no payout has been processed. Sections 1 and 2 apply to this website now. Sections 3 to 14 are not operative. They describe the terms intended to apply to the EarnWhile iOS app, they govern no service you can use today, and they will be finalised and published before the app becomes available. Several of the rules they describe — qualification, reward holding, forfeiture, retention and any tax treatment — are not settled, and are marked as such below. Where a specific figure is not stated, it is because it has not been decided; we would rather leave it blank than publish a number we might change.

1. Agreement

These Terms of Service form an agreement between you and ColbyCo Labs LLC (“ColbyCo Labs”, “we”, “us”), the company that operates the EarnWhile website and develops the EarnWhile iOS application.

By using this website, or by using the EarnWhile app once it is available, you agree to these terms. If you do not agree, please do not use them.

2. Using this website

This website is provided for information about EarnWhile. It is offered as-is, and we may change or remove any part of it at any time.

Content on this site describing the EarnWhile app is a description of software under development. It is not an offer, a guarantee that the app will be released, or a commitment to any particular feature, opportunity type, reward amount or release date.

3. Eligibility

You must be at least 18 years old to use EarnWhile, and you must be able to enter into a binding contract. You must not use EarnWhile if we have previously terminated your account.

Availability may be limited to particular countries. Individual opportunities often have their own eligibility requirements — age, location, device, or being a new user of a given service — set by the provider rather than by us.

4. Your account

You need an account to use the app. You agree to provide accurate information, to keep your sign-in credentials secure, and to tell us promptly if you believe your account has been compromised.

One account per person. Creating multiple accounts to claim rewards more than once is a breach of these terms.

You are responsible for activity that happens under your account.

5. Opportunities and third parties

EarnWhile surfaces and ranks earning opportunities. It does not create them. Opportunities are supplied by third-party providers, and completing one means dealing with that third party under their own terms and privacy policy.

We rank opportunities using information available to us, including information supplied by providers. Estimated earnings, estimated completion times, qualification rates and similar figures are estimates, not promises. Your actual result will vary, and you may not qualify for a given opportunity at all.

We are not responsible for the content, conduct, products or services of third-party providers, or for a provider's decision about whether you completed something.

6. Rewards, tracking and payouts

Nothing in this section is available today. No earning provider is enabled, and no opportunities are available. Cash out is unavailable, and no payout has been processed. The rest of section 6 describes how rewards and payouts are intended to work once there is something to earn, and will be finalised before release.
Not settled. The holding period, what counts as a qualifying completion, and how a provider's tracking and reversal behaviour is treated are open questions. No period, threshold or provider behaviour is established by anything below, and none is promised.

The states a reward record would move through

This describes a model, not an entitlement. Completing an opportunity would not immediately move a reward record to its cleared state: the provider would first have to report the completion to us, and the record would then sit for a holding period. The app models each stage separately — Tracking, Pending, and Available — so the stage a record had reached would be visible rather than folded into a single total.

Available names the final state in that model and nothing beyond it. It confers no ability to spend, use, redeem, transfer or withdraw anything, now or by implication later. Cash out is unavailable, and no payout has been processed.

Tracking failures

Rewards depend on a provider correctly reporting your completion. Tracking can fail for reasons outside our control, including ad blockers, VPNs, privacy settings, network problems, or provider errors. Where a completion is never reported to us, we cannot credit it, though you are welcome to contact support and we will look into it.

Reversals

A provider may reverse a reward after it has been credited — for example if they determine the activity was fraudulent, duplicated, or did not meet their requirements. Where that happens, the corresponding amount will be deducted from your balance. Reversals are shown in your wallet rather than applied silently.

Cashing out

Cash out is unavailable, and no payout has been processed. No payout method is enabled in the app, and nothing can currently be withdrawn, redeemed or received.

If cash-out is introduced, cleared rewards would be cashed out using the payout methods offered in the app at that time. Any minimum balance, the available payout methods, any fee and the processing times would be stated in the app before you request a payout, and this section would be updated before any of it took effect. No method, rail, minimum, fee, timescale or availability date is decided or promised here.

Reward balances are not bank deposits, are not insured, earn no interest, and are not transferable between accounts. They have no value outside EarnWhile.

7. Acceptable use

You agree not to:

  • create more than one account, or use another person's account;
  • use bots, scripts, emulators, automation or any means of simulating activity you did not genuinely perform;
  • provide false information in a survey or other opportunity, including misrepresenting who you are in order to pass a screener;
  • use VPNs, proxies or location spoofing to appear eligible for opportunities you are not eligible for;
  • interfere with, probe or attempt to gain unauthorised access to EarnWhile, our systems, or a provider's systems;
  • attempt to manipulate reward tracking or obtain rewards for activity that did not occur.

We may withhold or reverse rewards obtained in breach of this section, and close the account involved.

Not settled. The forfeiture rule this describes — what is withheld, on what finding, and with what route to dispute it — has not been decided. It is not operative, and no balance exists for it to apply to: No earning provider is enabled, and no opportunities are available.

8. Intellectual property

EarnWhile, the EarnWhile name and logo, this website, and the app and its underlying software are owned by ColbyCo Labs LLC and protected by intellectual property law. These terms grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose. They grant you no other rights.

Third-party names and trademarks that may appear in the app belong to their respective owners, and their appearance does not imply endorsement or a partnership unless we say so explicitly.

9. Suspension and termination

You may stop using EarnWhile at any time. Account deletion is not available yet. EarnWhile is in development and has not been released. There is no released app to delete an account from, so this paragraph describes an intended future path and not something you can do now: the design is that you would delete your account from inside the app. The Privacy Policy describes that path, and states in the same terms that it does not exist in any released product.

We may suspend or terminate an account that breaches these terms, that we reasonably believe is engaged in fraudulent activity, or where we are required to do so by law. Where an account is terminated for fraud, unpaid balances associated with the fraudulent activity may be forfeited.

Some records may be retained after termination where law requires it — see the Privacy Policy.

Not settled. Neither the forfeiture rule above nor the retention it refers to has been decided. No legal basis, retention period or tax treatment is established here or in the Privacy Policy, and none is implied by either. Cash out is unavailable, and no payout has been processed.

10. Disclaimers

EarnWhile is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

EarnWhile is not employment and is not an income opportunity. It is intended to be a way to earn small amounts of money in spare time. No earning provider is enabled, and no opportunities are available. We make no representation that you will earn any particular amount, or any amount at all. We do not guarantee that the service will be uninterrupted, error-free, or that any particular opportunity will be available to you.

11. Limitation of liability

To the fullest extent permitted by law, ColbyCo Labs LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost opportunity, arising out of your use of EarnWhile.

To the fullest extent permitted by law, our total liability for any claim relating to EarnWhile is limited to the greater of the total rewards credited to your account in the three months before the claim, or one hundred United States dollars (US$100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Governing law

These terms are governed by the laws of the United States and of the state in which ColbyCo Labs LLC is registered, without regard to conflict-of-law principles. The specific venue for disputes will be stated in the final version of these terms published before the app is released.

Nothing in these terms removes any right you have under the mandatory consumer protection law of the country you live in.

13. Changes

We may update these terms. The “last updated” date at the top shows the current version, and material changes will be communicated in the app. Continuing to use EarnWhile after a change means you accept the updated terms.
